Terms of Service & End User License Agreement (EULA)

These Terms of Service and End User License Agreement ("Terms", "EULA", or "Agreement") constitute a legally binding agreement between you ("User", "Breeder", or "Licensee") and Animal Birthday Predictor ("ABP Pro", "we", "us", or "our") governing your access to and use of the Animal Birthday Predictor mobile applications on iOS and Android, responsive web application, and associated vector PDF generation services.

1. License Grant & Permitted Use

Subject to your compliance with these Terms, ABP Pro grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the application on mobile devices and desktop browsers owned or controlled by you solely for your personal or commercial animal breeding, stud farm management, and veterinary record-keeping operations.

2. Professional Veterinary Clinical Disclaimer

NOT A SUBSTITUTE FOR LICENSED VETERINARY CARE:

Animal Birthday Predictor provides computational gestational schedules, milestone date reminders, and record-keeping certificates based on standard clinical formulas.

All calculations, milestone dates, and alerts are intended strictly as operational scheduling aids and management tools. They do not constitute veterinary clinical diagnosis, medical advice, or physical pregnancy verification. Actual gestation duration varies naturally by individual animal, breed, maternal age, seasonal photoperiod, and fetal sex. You must always engage a qualified, licensed veterinary surgeon for transrectal ultrasound examination, specialized procedures, Caslick surgeries, and foaling supervision.

3. Account Registration & Data Integrity

To access cloud synchronization, herd registries, and vector certificate generation, you must register an account with a valid email address and password. You agree to:

• Provide true, accurate, and current information regarding animal parentage, microchips, breeding dates, and attending veterinary practitioner details.
• Maintain the security of your authentication credentials and promptly notify our support team at support@animalbirthdaypredictor.com of any unauthorized account access.
• Refrain from issuing fraudulent certificates, misrepresenting stallion parentage, or fabricating veterinary attestations.

4. Certificate Entitlements, In-App Purchases & Quotas

ABP Pro employs a transparent entitlement quota model for vector certificate generation:

• Free Starter Quota: Each newly registered breeder account is granted 5 free starter certificate credits to explore the platform without payment.
• Credit Packs: Additional certificate credits can be purchased as consumable In-App Purchases (Single Certificate, Professional 5-Pack, Commercial 20-Pack).
• Free Unlimited Re-Downloads: Generating a newly issued certificate for an animal record consumes 1 credit. Once generated, re-downloading, printing via AirPrint/Android Print, or sharing that certificate is permanently free and does not consume credits.
• Payment Processing: In-app purchases are billed through your Apple App Store (StoreKit) or Google Play Billing account. Prices are displayed in local currencies and include applicable sales tax or VAT.
• Refund Policy: In-app purchase refund requests are governed by Apple Media Services Terms and Conditions or Google Play Terms of Service. If you experience a technical failure where credits were deducted without certificate rendering, contact support@animalbirthdaypredictor.com for immediate quota adjustment.

5. Intellectual Property Rights

All intellectual property rights in the ABP Pro application, including but not limited to the codebase, application architecture, vector PDF layouts, double-ruled Imperial Gold certificate borders, graphics, logos, and algorithmic gestation calculations, are and remain the exclusive property of Animal Birthday Predictor.

You retain full ownership of all proprietary animal data, photos, pedigree lineages, and breeding logs you upload to your account.

6. Termination & Account Deletion

You may terminate this Agreement at any time by ceasing all use of the application and requesting the permanent deletion of your account. In compliance with mobile store policies, you may execute account and data erasure directly in-app (Profile → Settings → Delete Account) or via our web-based Account & Data Deletion Portal.

We reserve the right to suspend or terminate accounts that engage in fraudulent certificate generation, system abuse, or infringement of third-party intellectual property.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Animal Birthday Predictor and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of livestock, neonatal mortality, veterinary expenses, breeding fees, stud book registration disputes, or lost profits arising out of your use of or inability to use the platform.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions. Any disputes shall be resolved through good-faith negotiation or appropriate legal channels.
